EvenSides is a software platform operated by EvenSides LLC, a Massachusetts limited liability company ("we," "us," or "EvenSides"). The platform is accessible at evensides.com. Contact: alex@evensides.com.
EvenSides is a coordination tool for independent groups of adult recreational players to organize pickup sports games (currently soccer). We provide software for player profiles, RSVPs, team balancing, group communication, and, for groups that choose to use it, collecting each player's share of the cost of a game.
We do not organize, supervise, staff, referee, coach, or insure any game or event. Games are run by independent volunteer organizers. EvenSides is a tool, not a league.
You must be at least 18 years old to use EvenSides. You must be at least 18 years old to create an account. Minors do not hold accounts; a minor may participate in a game only where the group permits it and a parent or guardian has completed the minor waiver process. By creating an account, you confirm you meet this requirement. Misrepresenting your age is a material breach of these Terms and grounds for immediate account termination. It does not void these Terms, the Participant Waiver, or any release, limitation of liability, or indemnification in them, all of which remain enforceable to the fullest extent permitted by law.
You are responsible for keeping your account credentials secure. You agree to provide accurate information in your profile. You may not impersonate another person or create multiple accounts to circumvent moderation.
We may suspend or terminate accounts that violate these Terms, the Participant Waiver, or the reasonable instructions of group organizers, at our sole discretion and without notice.
Before participating in any game, you must sign the EvenSides Participant Waiver. The Waiver governs the legal relationship between you and EvenSides regarding event participation and inherent physical risks. The Waiver is incorporated into these Terms by reference.
If there is any conflict between these Terms and the Waiver regarding event participation, the Waiver controls.
Group organizers are independent individuals who use EvenSides as a tool. They are not employees, agents, or contractors of EvenSides. EvenSides does not select, train, certify, or supervise organizers, and we do not control how individual groups schedule, run, or moderate their events.
Where a group uses paid games, EvenSides collects the field fee from players and passes the organizer's share to them after the game is played, as described in section 9. That payment reimburses the cost of running the game. It does not make an organizer an employee, agent, or contractor of EvenSides, and it does not mean we supervise, staff, or insure their games.
We may remove an organizer's access to the platform if they violate these Terms, but we are under no obligation to monitor or enforce organizer behavior.
You may upload a profile photo, a self-description, and other text content. By uploading content, you grant EvenSides a non-exclusive, royalty-free license to display that content within the platform for the purpose of operating the service.
You retain ownership of your content. You represent that you have the right to upload anything you submit. We may remove user content that we determine to be unlawful, harassing, or in violation of these Terms.
You agree not to:
Organizer subscriptions. Operating a group beyond the free trial requires a paid subscription billed to the group's Organizer. Current pricing is shown at /pricing and at checkout. Prices do not include applicable taxes; where required by law, sales tax is calculated and added at checkout.
Free trial. New groups receive a 90 day free trial. If the trial ends without an active subscription, the group enters a limited state: existing scheduled games continue, but new games cannot be created until a subscription is active.
Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) until canceled. You can cancel at any time through the billing portal linked from your group settings. Cancellation stops future renewals; your subscription remains active through the end of the period already paid.
Subscription refunds. Except where required by law, subscription payments are non-refundable and we do not provide refunds or credits for partial billing periods. This paragraph is about organizer subscriptions only. Player payments for individual games are refunded under the rules in section 9A below.
Failed payments. If a renewal payment fails, we may retry the charge and will notify you. Until payment succeeds, the group enters the limited state described above.
Price changes. We may change subscription pricing with at least 30 days notice. Changes apply at your next renewal. Founding cohort pricing remains in effect for founding subscribers for as long as their subscription remains continuously active.
Payment processing. Payments are processed by Stripe, Inc. EvenSides does not receive or store your full card number.
Some groups charge players a share of what a game costs to run, such as the field, lights, referees, or equipment. This section governs those payments. It applies to you as a player whenever you pay for a spot in a game through EvenSides.
You pay EvenSides, not your organizer. When you pay for a spot, the money goes to EvenSides. We hold it, and we transfer the organizer's share to them roughly 24 hours after a result is recorded for the game. Your organizer is never paid at the moment you book. The delay is deliberate: it leaves a window in which somebody can object before the money is gone.
What you are charged. You pay the field fee your organizer set, plus an EvenSides service fee, shown to you as separate lines and as a single total before you pay. The amount you are shown at checkout is the full amount you owe for that game. There is nothing extra to pay at the field, and your organizer is not permitted to ask you to pay again by cash or any other method for a game you paid for in the app.
When you get your money back. Every refund is for the full amount you paid, including the service fee. We do not issue partial refunds on any of these paths. You are refunded in full when:
When you do not. If you drop out of a game you paid for and nobody else buys your spot, your payment stands. The field costs your organizer the same whether or not you turn up, so the spot was committed when you paid for it. Being suspended or banned from a group does not by itself refund a game you already paid for, though no organizer may remove you from a paid game and keep your money.
Disputed charges. If you dispute a charge with your bank rather than contacting us, your bank decides the outcome and EvenSides bears the cost. We would rather you contact us first at alex@evensides.com, because every path above is faster than a bank dispute and returns the whole amount.
Paid games are for adults. EvenSides does not collect payment for a participant under 18.
What we do not arbitrate. We refund games that were not delivered. We do not arbitrate complaints about how a game went, who played, or how teams were picked. Those are between you and your organizer.
EvenSides is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee uptime, accuracy of skill ratings, fairness of team balancing, delivery of notifications, or any other specific outcome. The platform is in active development. Bugs, downtime, and data loss are possible.
We reserve the right to modify, suspend, or discontinue any feature at any time.
To the fullest extent permitted by Massachusetts law:
This limitation does not apply to liability that cannot be limited under Massachusetts law (such as gross negligence, recklessness, or intentional misconduct).
You agree to indemnify, defend, and hold EvenSides harmless from any claim, loss, damage, or cost (including reasonable attorney fees) arising from your use of the platform, your content, your participation in any Event, or your violation of these Terms.
Our handling of your personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.
You may stop using the platform and delete your account at any time. Upon termination, your right to use the platform ends, but the Waiver, indemnification provisions, and limitations of liability survive.
We may update these Terms from time to time. Material changes will be communicated through the platform or email. Continued use after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute arising from these Terms must be brought in the state or federal courts located in Norfolk County or Suffolk County, Massachusetts. You consent to personal jurisdiction in those courts.
If any provision of these Terms is unenforceable, the remaining provisions remain in effect. These Terms, together with the Participant Waiver and Privacy Policy, are the entire agreement between you and EvenSides.
