EvenSides is a software platform operated by EvenSides LLC, a Massachusetts limited liability company ("EvenSides," "we," "us"). The platform is available at evensides.com, through links in email, through the EvenSides Telegram bot, and through the EvenSides apps for iOS and Android. These Terms apply to all of them, and to any successor app or domain we operate for the same service. Our registered address and contact details are at evensides.com/contact.
By creating an account, joining a group, RSVPing to a game, or otherwise using the platform, you agree to these Terms, the Privacy Policy, and the Community Rules. If you do not agree, do not use the platform.
EvenSides is a coordination tool for independent groups of adults who play recreational sports together. Organizers use it to run rosters, collect RSVPs, balance teams, send notices, and, where a group chooses, collect each player's share of the cost of a game. The platform started with soccer and supports other sports as they are added; these Terms apply to every sport and activity coordinated through it, including league or season play where a group uses it.
We provide software. We do not run games. EvenSides does not organize, host, supervise, staff, referee, coach, inspect, or insure any game or event. Games are run by independent Organizers who decide where, when, and how they take place and who plays. EvenSides is not a league, a club, a venue, an event operator, or a party to any game.
Where the platform lists public groups ("Find games"), it is a directory. Listing a group does not mean EvenSides has vetted the group, its Organizer, or its venue. If a game is full you can join its waitlist; when a spot opens, the next player on the waitlist is moved into the game automatically and notified, and the usual cancellation rules then apply to them.
You must be at least 18 years old to create an account or to use the platform. Minors do not hold accounts. EvenSides does not decide who may attend a game. Whether a person under 18 may take part is the Organizer's decision, and the Organizer is responsible for obtaining a present parent or guardian's written consent and release before a minor takes part; the EvenSides minor participation form at /minor-waiver may be used for this. It does not create an account for the minor, and EvenSides does not supervise minors or collect payment for a minor.
By creating an account you confirm you are at least 18. Misrepresenting your age is a material breach of these Terms and grounds for immediate termination. It does not void these Terms, the Participant Agreement, or any release, limitation of liability, or indemnification in them, all of which remain enforceable to the fullest extent permitted by law.
You are responsible for keeping your credentials secure and for everything done through your account. You agree to give accurate information in your profile and to keep it current. You may not impersonate anyone or create more than one account to get around a moderation decision.
You can sign in with an email address and password, with Google, or, in the iOS app, with Apple. Those providers' own terms apply to your use of them.
We may suspend or terminate an account that violates these Terms, the Participant Agreement, or the Community Rules, or that ignores the reasonable instructions of an Organizer, at our discretion and without notice.
Before you can RSVP to a game, you must accept the EvenSides Participant Agreement, Release of Liability, and Assumption of Risk (the "Participant Agreement"). You accept it once; it stays in effect until you accept a replacement or close your account. It covers every game you take part in, in any sport, with any group, free or paid, on any channel. The current text is always at evensides.com/participant-agreement, and it is incorporated into these Terms by reference.
If we publish a replacement, players who have not accepted it are shown it the next time they RSVP, on whichever channel they use, and the RSVP does not go through until they accept. There is no separate signing step. Until you accept a replacement, the version you accepted stays in force.
If these Terms and the Participant Agreement conflict on anything about the risks of taking part in a game or the release of liability, the Participant Agreement controls. On everything else, including payments, these Terms control.
Your Organizers and the other Released Parties named in the Participant Agreement are intended third-party beneficiaries of it and may enforce it against you.
Guests. Some groups let you bring a guest. A guest does not hold an account and does not accept the Participant Agreement; section 7 of that agreement says what you confirm and take on when you bring one, including that your guest is at least 18. You RSVP for your guest and, on a paid game, you pay for their spot, and any refund for it comes to you.
Organizers are independent individuals who use EvenSides as a tool. They are not employees, agents, contractors, or representatives of EvenSides. EvenSides does not select, train, certify, or supervise Organizers, and we do not control how a group schedules, runs, or moderates its games.
If you organize a group, you run it, and you are responsible for it. By creating or organizing a group, whether or not it charges for games, you agree that you, and not EvenSides:
The moderation tools EvenSides provides (warnings, suspensions, reports, automatic refunds) exist to protect the platform and its users. Using them does not make EvenSides the operator of any game.
Where a group uses paid games, the Organizer also accepts the Operator Agreement before collecting any money. That agreement governs paid games as between EvenSides and the Organizer.
We may remove an Organizer's access to the platform, or transfer a group to another Organizer, if the Organizer violates these Terms, but we are under no obligation to monitor or enforce Organizer behavior.
The Community Rules apply to everyone on the platform. Players can report another player or an Organizer from within the app. Reports go to the group's Organizers, who decide attendance and conduct in their group. Reports about threats, slurs or hate speech, sexual harassment, or Organizer misconduct also go to EvenSides support. EvenSides may warn, suspend, or ban an account from the platform for violations, and may act on a report at its discretion. We do not referee games and we do not decide disputes about how a game went. The app records late cancellations against your group's cutoff, Organizers record no-shows, and after three no-shows in a group the app blocks your RSVPs in that group until an Organizer clears the block.
You may upload a profile photo, a description, notes to Organizers, messages, reports with attachments, results, and other content. You keep ownership of it. You grant EvenSides a non-exclusive, worldwide, royalty-free license to store, display, and transmit that content within the platform, and to Organizers and group members as the platform's features require, for the purpose of operating the service. You represent that you have the right to upload anything you submit. We may remove content that we consider unlawful, harassing, or in breach of these Terms.
A profile photo is required and must reasonably allow other players to recognize you in person. The Privacy Policy explains what is acceptable and how photos are stored.
You agree not to:
Players never pay a subscription. Running a group beyond the free trial requires a paid subscription, billed to the group's Organizer, one subscription per group. Collecting player field fees requires an active paid subscription; it is not available during the free trial, while a renewal payment is past due, or after a cancellation takes effect.
Price. The current prices are shown at /pricing and at checkout before you pay. Founding Organizer pricing is $15 per month or $130 per year per group. Standard pricing for later cohorts is $19 per month or $180 per year per group. Prices are shown without sales tax. If sales tax applies to your subscription, it is shown at checkout before you pay.
Founding pricing. A group on founding pricing keeps that price for as long as its subscription stays active. It is the price for that group, not for other groups created later. If the subscription is cancelled or lapses and is later restarted, the price in effect for that group at that time applies. We may change founding pricing only with the notice described below, and only if we change it for every founding group.
Free trial. Each Organizer gets one 90-day free trial, starting when they create their first group. No payment card is needed to start it, nothing is charged when it ends, and nothing is charged automatically unless you subscribe. Any further group the same Organizer creates shares that same 90-day window, and a group created after the window has ended needs a subscription from the start. When the trial ends without an active subscription, the group enters a limited state: existing scheduled games continue, members keep their access, and no new games can be created until a subscription is active.
Subscribing during the trial. If you subscribe before your trial ends, you choose either to keep the rest of your free trial, in which case your card is saved now and first charged automatically on the day the trial ends, or to start billing immediately. The date of your first charge, the amount, and the billing period are shown before you confirm, and you can cancel before that date from your group's settings and will not be charged.
Automatic renewal. A subscription renews automatically at the end of each monthly or annual billing period, at the price in effect for your group, until it is cancelled. Your card is charged on each renewal date. We will tell you by email before any price change takes effect.
Cancelling. You can cancel at any time from the Billing card in your group's settings on evensides.com, or through the billing portal linked there, or by emailing support@evensides.com. Cancelling stops future renewals; your subscription stays active until the end of the period you have already paid for, and you are not charged again. Cancelling a subscription does not delete the group.
Refunds. Except where the law requires it, subscription payments are not refundable and we do not give refunds or credits for partial billing periods. This applies only to Organizer subscriptions. Player payments for games are refunded under section 11.
Failed payments. If a renewal charge fails, Stripe may retry it and may email you; EvenSides does not send a separate notice. From the first failed charge until a charge succeeds, the group enters the limited state described above, and players cannot pay for games in the group.
Price changes. We may change subscription prices with at least 30 days' notice by email. A change applies from your next renewal after the notice period.
Payment processing. Subscriptions are processed by Stripe, Inc. Stripe receives your card details directly; EvenSides never receives or stores your full card number. Subscriptions are sold on our website only, not through the Apple App Store or Google Play, and nothing in the apps sells them.
Some groups charge players a share of what a game costs to run, such as the field, lights, referees, or equipment. This section applies whenever you pay for a spot in a game through EvenSides. Paid games are available only where EvenSides has enabled them, and only for adults.
Who you are paying. The field fee is your Organizer's charge for a spot in their game. EvenSides collects it on your Organizer's behalf, as the Organizer's limited payment collection agent, and your Organizer holds EvenSides out as accepting field fees on their behalf. When EvenSides receives your payment, your Organizer is treated as having received it, and you owe your Organizer nothing more for that spot. EvenSides keeps the field fee in its account with Stripe, its payment processor, and releases it to your Organizer after the game, as described below. EvenSides does not set the field fee, does not own the game, and does not become the organizer of it by collecting the fee.
The service fee. On top of the field fee you pay EvenSides a service fee of 3.9% of the field fee plus $1.00 per payment. It is EvenSides' own charge for its software and payment handling; it is not collected for your Organizer. The field fee and the service fee are shown as separate lines, and as a single total, before you pay. The total shown at checkout is the full amount you owe for that game. There is nothing extra to pay at the field, and your Organizer may not ask you to pay again by cash or any other method for a game you paid for in the app. Field fees below $5 per person are not supported. One payment can cover you and up to two guests, charged per person; any refund for a guest's spot is paid to you, not to your guest.
Paying is your RSVP. On a paid game, your spot is confirmed only when your payment succeeds. Until then you do not hold a spot. If the game fills before your payment completes, you are not charged.
When the Organizer is paid. EvenSides releases the field fee to the Organizer about 24 hours after a result is recorded for the game. The Organizer is never paid at the moment you book. The delay exists so that there is a window in which somebody can object before the money moves. Release is held longer if a report that the game did not happen is under review (see below), or while your Organizer's Stripe account is unable to receive transfers. Stripe may also delay or hold a payout to an Organizer for its own risk, fraud, or compliance review, and EvenSides may hold the money for a game while a report, a card dispute, or a suspected breach of these Terms is being looked into. A hold delays the release; it does not change who the money is owed to.
When you get your money back. Every refund is for the full amount you paid, including the service fee. We do not issue partial refunds on any of these paths. You are refunded in full, automatically, when:
When you do not. If you drop out of a game you paid for and nobody else buys your spot, your payment stands. The field costs the Organizer the same whether or not you turn up, so the spot was committed when you paid for it. Dropping out inside your group's cancellation cutoff is also recorded as a late cancellation in that group. Being suspended or banned from a group does not by itself refund a game you already paid for, but no Organizer may remove you from a paid game and keep your money. If you have already disputed a charge with your card issuer, we do not also refund it; the dispute decides that payment.
Organizer no-shows. If the Organizer does not deliver a game you paid for, the Organizer must cancel it in the app, which refunds everyone. If they do not, the 7-day rule above refunds you. The Organizer, not EvenSides, is responsible for delivering the game; EvenSides' obligation is to return your money through these paths.
Disputed charges. If you dispute a charge with your card issuer instead of contacting us, your issuer decides the outcome. Every path above is faster than a card dispute and returns the whole amount, so please contact us first at support@evensides.com. Filing a card dispute for a payment that these Terms say stands, or that EvenSides has already refunded, is a breach of these Terms and may lead to suspension of your account. We may give your card issuer the record of your RSVP, your acceptance of the Participant Agreement, and the game result in response to a dispute.
What we do not do. EvenSides decides only whether a paid game took place, so that it can refund games that were not delivered. We do not decide complaints about how a game went, who played, or how teams were picked. Those are between you and your Organizer.
We send email about your account and your games: invitations, reminders, team lists, results and rating prompts, weather notes, waitlist changes, cancellations, conduct notices, and, for Organizers, trial and billing notices. You can turn game emails off in your profile or with the unsubscribe link in any game email; account, billing, cancellation, and conduct notices are sent regardless because they are part of running your account. We do not send advertising or newsletters.
If your group links the EvenSides Telegram bot, game posts and one-tap RSVPs appear in your group's Telegram chat, and the bot may send you direct messages such as Organizer announcements or a request to accept an updated agreement. Your Organizer decides who is in that chat. Telegram's own terms apply to your use of Telegram.
If you use the calendar feed, anyone with your feed link can read it; keep the link private.
The EvenSides apps for iOS and Android are the same service under these Terms. You can delete your account from inside the app at any time (Profile, then Delete account).
Apple. If you downloaded the app from the Apple App Store, Apple's Licensed Application End User License Agreement applies to your license to the app itself, and these Terms govern everything else. You acknowledge that these Terms are between you and EvenSides, not Apple; that EvenSides, not Apple, is solely responsible for the app, its content, maintenance, and support; that Apple has no obligation to furnish maintenance or support for the app; that if the app fails to conform to an applicable warranty you may notify Apple and Apple may refund the purchase price, which is zero, and that all other claims, losses, and liabilities are EvenSides' responsibility; that EvenSides, not Apple, is responsible for addressing any claim that the app or your use of it infringes a third party's intellectual property rights, or any product, regulatory, or privacy claim relating to it; that you must comply with applicable third-party terms when using the app; and that Apple and its subsidiaries are third-party beneficiaries of these Terms as they apply to the iOS app and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo or designated as terrorist supporting, and that you are not on any U.S. government list of prohibited or restricted parties.
Google. If you downloaded the app from Google Play, the Google Play Terms of Service also apply to the download. Google is not a party to these Terms and is not responsible for the app.
Organizer subscriptions and paid-game setup are not sold inside the apps; they are managed on evensides.com. Neither Apple nor Google is responsible for billing, refunds, or payment disputes.
How we collect and use personal data is described in the Privacy Policy, which is part of these Terms. Organizers see certain profile details of the players in their groups, as the Privacy Policy describes, and are responsible for how they use that information outside the app.
The platform, including its software, design, rating and team-balancing systems, text, and marks, belongs to EvenSides LLC or its licensors. These Terms give you a limited, revocable, non-transferable right to use the platform for its intended purpose. If you send us feedback or suggestions, we may use them without obligation to you.
EvenSides is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uptime, the accuracy of skill ratings, the fairness of team balancing, the accuracy of weather forecasts or venue maps, the delivery of any email or Telegram message, or any other outcome. The platform is in active development; bugs, downtime, and data loss are possible. We may change, suspend, or discontinue any feature at any time.
To the fullest extent permitted by Massachusetts law:
These limits do not cap a refund we owe you under section 11, an amount we owe an Organizer under the Operator Agreement, or liability that cannot be limited under Massachusetts law, including liability for gross negligence, recklessness, or intentional misconduct.
You agree to indemnify, defend, and hold harmless EvenSides LLC, its member(s), managers, employees, contractors, and agents from any claim, loss, damage, or cost, including reasonable legal fees, arising from your content, your breach of these Terms or the Community Rules, or your violation of any law. If you organize a group, this also covers claims arising from the games you run, the venues you use, and the participants you admit, except to the extent a claim is caused by EvenSides' own negligence or by a defect in the software. Indemnity for your own taking part in a game is governed by the Participant Agreement, not by this section. This section does not make you responsible for a claim between other people that you were not involved in.
You may stop using the platform and delete your account from your Profile at any time, subject to the steps in section 6 of the Privacy Policy (for example cancelling a subscription or transferring group ownership first). We may suspend or terminate your access as described in section 4. When your account ends, your right to use the platform ends. The Participant Agreement, the indemnities, the limitations of liability, the payment terms for anything that happened before termination, and the records we keep under the Privacy Policy survive.
We may change these Terms. Each version carries a version number and a date, is posted at evensides.com/terms, and earlier versions are available on request. For a material change we will give at least 30 days' notice by email or in the app before it takes effect, and where a change materially affects your rights we will ask you to accept the new version in the app or on the website before you continue. Other changes take effect when posted. A change does not apply to a dispute that arose before its effective date. If you do not agree to a change, stop using the platform and delete your account before it takes effect. Changes to these Terms do not change the Participant Agreement; that agreement changes only when you accept a replacement.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the platform must be brought in the state or federal courts located in Norfolk County or Suffolk County, Massachusetts, and you consent to personal jurisdiction in those courts. Before filing anything, please contact us; most problems are quicker to fix than to litigate.
If you believe content on the platform infringes your copyright, email support@evensides.com with the work, the content you object to and where it appears, your contact details, and a statement that you believe in good faith the use is not authorized. We will review the notice and may remove the content.
If any provision of these Terms is unenforceable, the rest remain in effect. These Terms, the Participant Agreement, the Privacy Policy, the Community Rules, and, for Organizers of paid games, the Operator Agreement, are the entire agreement between you and EvenSides. On the risks of taking part in a game and the release of liability, the Participant Agreement controls; on paid games as between EvenSides and an Organizer, the Operator Agreement controls; otherwise these Terms control. You may not assign these Terms; we may assign them to a successor of the service. Our not enforcing a provision is not a waiver of it. Headings are for convenience only.
